Why do we need another petition? The Town Supervisor rejected the previous petition on several grounds, but a state supreme court judge reversed his decisions and ordered that a vote take place. An appellate court threw out all of the Supervisor’s purported reasons for rejecting the petition except for one: his claim that the description of the boundaries for the proposed village was not sufficiently clear.
Why do we believe the petition will be successful this time? In the previous petition, we relied on a nearly 100-year old description of the Greenville Fire District’s boundaries that was used when the district was originally established in 1923. Because this is the official, legal description of the district, we expected it to be sufficient for purposes of defining the boundaries of the village as well. However, the appellate court found that the description was not clear enough.
With that guidance, we engaged the services of a licensed professional engineer/surveyor who, using modern GPS technology and historical maps, has drawn a new description of the proposed boundary. We believe it easily satisfies the statutory requirement of a description sufficient to identify the territory with “common certainty.”
Will the proposed boundaries of the Village of Edgemont be the same as the boundaries in the prior petitions? No. In the previous EIC petition, the proposed village territory was coterminous with the Greenville Fire District’s territory. The new territory includes all homes in the Greenville Fire District and the Edgemont School District.
Can I review an official map of the Village of Edgemont? New York Village Law §2-202(c)(1) requires a sufficient description in either metes and bounds form, reference to streets and navigable waters, a map, or a combination thereof. Our petition carries a metes and bounds description. Do I have to sign again if I signed petitions 1, 2, or both? If you remain in favor of holding a vote on incorporation, yes.
If I have multiple signers in my household who are in favor of a vote, should all of them sign? Yes, if they are qualified voters. The legal threshold is met through the number of qualified voters who sign, not the number of households.
Does incorporation affect my status as a resident of the Edgemont School District? Absolutely not. Incorporation has no effect whatsoever on the school district’s borders, enrollment eligibility, school taxes, or school district governance. If you reside within the Edgemont School District now, you will remain a school district resident whether or not Edgemont incorporates.
